Penalties for Reckless Driving Racing

Racing under Va. Code 46.2-865 is the most serious form of reckless driving. Unlike other types of reckless driving, racing comes with a minimum of 6 months loss of license and a maximum license suspension of two years. That is four times the license suspension of regular reckless driving.

Cars used for racing under this law can (in some situations) be confiscated by the commonwealth and aiding or abetting in a race is a separate crime under 46.2-866 even if the person does not participate. The maximum fine for reckless driving by racing is $2,500 and there is a maximum penalty of up to 12 months in jail as well.
